1. Introduction
These General Conditions of Contract (hereinafter, the "General Conditions") regulate the process of acquiring experiences of accommodation, restaurant and recreational activities (hereinafter, the "Experiences") offered through the site website (henceforth, the "Platform") of the company PINODIL SA (henceforth, the "Company"), with NIF A17306861 and address at Cala Joncols S/N 17480 Roses (Girona), Spain.
The use of the Platform implies the acceptance of these General Conditions, as well as the Privacy Policy and the Cookies Policy.
2. Users
Experiences can be acquired through the Platform by those of legal age and with full capacity to contract in accordance with the applicable legislation.
3. Recruitment process
To acquire an Experience, the user must select the desired Experience, indicate the dates and the number of people, and complete the registration form with the requested data. Once the form is completed, the user must make the corresponding payment through the available means of payment.
4. Prices and payment
The prices of the Experiences include VAT and other applicable taxes. Payment will be made through the means of payment offered on the Platform, which may include credit or debit cards, bank transfer or other electronic payment systems.
5. Confirmation of the reservation
Once the payment has been made, the user will receive an email with confirmation of the reservation and its details. The user must verify that the data is correct and, if any error is detected, contact the Company for correction.
6. Cancellations and returns
The user may cancel the reservation of an Experience with the right to a full refund of the price paid as long as he does so at least 48 hours in advance of the start of the Experience. In case of cancellation less than 48 hours in advance, no refund will be made.
7. Liability of the Company
The Company will not be responsible for the acts or omissions of third parties, such as accommodation providers, restaurants or entertainment companies, nor for the damages that they may cause.
8. Data protection
Information regarding the processing of users' personal data can be found in the Platform's Privacy Policy. The use of the Platform implies acceptance of the Privacy Policy and compliance with the processing of personal data in accordance with applicable legislation, including Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 of April 2016, relating to the protection of natural persons with regard to the processing of personal data and the free movement of such data (General Data Protection Regulation).
9. Intellectual and industrial property
The Platform, its contents, logos, brands, designs and any other element that appears on it are protected by intellectual and industrial property laws. The reproduction, distribution, public communication, making available, transformation, manipulation or any other form of exploitation of the Platform or its contents, in whole or in part, without the express written authorization of the Company, is expressly prohibited.
10. Modification of the General Conditions
The Company reserves the right to modify these General Conditions at any time, without prior notice. The modifications will take effect from their publication on the Platform. The user accepts that it is their responsibility to review the General Conditions periodically to be informed of updates.
11. Applicable legislation and jurisdiction
These General Conditions will be governed and interpreted in accordance with Spanish legislation. Any dispute or claim arising from the use of the Platform or the contracting of Experiences will be submitted to the courts and tribunals of the user's domicile, provided that this is located in the territory of the Spanish State, or to the courts and tribunals of the city of Girona, if the user is domiciled outside Spain.
